Article 1 : General provisions

The electronic webstock of Larabesko, a BVBA with registered office in Ghent (Belgium), Bagattenstraat 122, VAT BE0835.089.331, hereinafter ‘Larabesko’ or “the company”, offers its customers the opportunity to make follow-up orders online for customized purchases in the shop and only in this case. The present general terms and conditions apply to all items from the Larabesko range and all follow-up orders placed by the customer at www.larabesko.com. The customer accepts that these terms and conditions will be the only ones applicable, to the exclusion of his own general or specific ( purchase) conditions, even if they stipulate that they are the only ones that apply.

Only persons who are legally capable of making binding agreements can make follow-up orders online. Minors under the age of 18 cannot place orders online. The original purchase is always made in person at the Larabesko shop, with individual customer measurements taken by Larabesko’s qualified employees. N.a.v. this purchase is an online registration possible.

Online orders for this customized services and goods are only possible for customers living in Belgium. Shipment takes place exclusively within the territory of Belgium, to the address specified by the customer.

Article 2 : Price

All prices quoted are always inclusive of VAT and all other mandatory taxes to be borne by the customer. The stated prices also include the services of the qualified employees of Larabesko. If transport, reservation or administrative costs are charged, this will be stated separately. The indication of price only refers to articles as described verbatim. The accompanying photo is intended for decorative purposes and may contain elements and articles (eg jewelry, hair, decoration, accessories …) that are not included in the price.

Article 3 : Goods and services

Each offer is only open to customers residing in Belgium. The articles are only intended for normal private use. Despite the fact that the catalog and website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors or is not up-to-date. If you have specific questions about, for example, sizes, color, availability, customization, delivery method or delivery time, please contact our store, where the qualified Larabesko employees will help you further.

Larabesko is what the accuracy, updating or completeness of the information provided is merely bound to an obligation of means. Larabesko is in no way liable in the event of material errors, typesetting or printing errors. Prices can be adjusted or withdrawn at any time. Larabesko is entitled – without stating reasons – to refuse orders, to adjust the delivery times, to split the deliveries, or to attach other conditions to the delivery.

Article 4 : Backorders

The customer who has received an online registration as a result of the purchase in a store has the option of re-ordering the items from the Larabesko range online based on the size data recorded by the Larabesko employees. The customer can choose between the following payment methods:

  • By creditcard
  • By bank card
  • By bank transfer
  • Cash at our store in Ghent

Items will be shipped within 2 days of receipt of payment. If no payment has been received 7 days after confirmation of the order, Larabesko can cancel the order without any notice of default. Delivery times are always indicative and do not bind Larabesko.

Article 5 : Retention of title

The delivered items remain the exclusive property of Larabesko until full payment by the customer. However, the risk of loss or damage is transferred to the customer from shipment by Larabesko. The customer undertakes, if necessary, to inform third parties of the retention of title of Larabesko, for example anyone who would seize articles that have not yet been fully paid for.

Article 6 : Penalties for non-payment

Without prejudice to the exercise of other rights that Larabesko has, the customer owes interest of 1% per month on the unpaid amount in the event of non-payment or late payment from the date of the default and without notice of default. In addition, the customer is legally and without notice of default due a fixed compensation of 10% on the amount concerned, with a minimum of 25.00 euros per invoice. Notwithstanding the foregoing, Larabesko reserves the right to take back items that have not been paid (in full).

Artikcle 7 : Complaints

Any visible damage and / or qualitative shortcoming of an article or other shortcoming in delivery must be reported within 2 days of receipt of the order, under penalty of forfeiture of any right.

Will not be taken back under any circumstances:

  • used, dirty, damaged or incomplete articles
  • articles whose packaging (or part of it) has been damaged
  • articles made to measure for the customer
  • items ordered at the request of the customer
  • hand broken pointes
  • items that cannot be returned due to their nature

Article 8 : Guarantee (consumers only)

The provisions of this article only apply to customers who purchase articles online in their capacity as consumers.

Under the law of September 1, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. Each item is subject to the legal warranty from the date of purchase by (where applicable, delivery to) the first owner. Any commercial guarantee does not affect these rights.

b. In general

To invoke the warranty, the customer must be able to present the proof of purchase and the customer must contact Larabesko in advance, after which the customer personally returns the item to the store, located at Bagattenstraat 122, 9000 Ghent during the normal opening hours. Any defect must be reported within two months of its discovery. Afterwards, any right to repair or replacement lapses.

The (commercial and / or legal) guarantee never applies to defects that arise as a result of accidents, neglect, falls, abnormal or incorrect use, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or changes to the item, rough use, poor maintenance, abnormal or incorrect use.

Nor does it apply to articles with a shorter lifespan or wear articles. Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable, delivery, are deemed not to be defects, unless the customer proves otherwise. The warranty is not transferable.

Larabesko undertakes to use your data exclusively for the performance of this agreement and to send you information from Larabesko without obligation. If you would also like to receive information by e-mail, please also provide your e-mail address. We treat your data as confidential information and will never pass it on, rent or sell it to third parties.

You can request, correct, change or have your data that we store in the customer list of Larabesko deleted at any time and you can refuse Larabesko to use your data to send you information. The customer is responsible for keeping his log-in data confidential and for the use of his password. Your password is stored encrypted, so Larabesko has no access to your password. Larabesko strictly respects the Belgian law of December 8, 1992 regarding the protection of privacy in the processing of personal data. You have access through your user profile to all of the data available about you on Larabesko for consultation, modification or deletion.

Larabesko uses cookies. Cookies consist of a standard internet technology that makes it possible to store and access certain information on the user’s system. Cookies cannot be used to identify persons, a cookie can only identify a machine. Every internet user can set his computer in such a way that cookies are not accepted. If your computer does not accept cookies, you may experience problems during the ordering process. If this is the case, we request that you contact us so that we can still enter your order.

Larabesko keeps online (anonymous) visitor statistics in order to see which pages of the internet site are visited to what extent. Under no circumstances can Larabesko be held liable for any direct or indirect damage resulting from incorrect or unlawful use by a third party of the personal data. Article 10 : Force majeure

In case of force majeure, Larabesko is not obliged to fulfill its obligations. In this case, Larabesko can either suspend its obligations for the duration of the force majeure or terminate the agreement definitively.

Force majeure is any circumstance beyond the will and control of Larabesko that prevents the fulfillment of its obligations in whole or in part, including, but not limited to, strikes, fire, operational disruptions, power failures, disruptions in a (telecommunications) network or connection or communication systems used. and / or the website being unavailable at any time, non-delivery or late delivery by suppliers or other engaged third parties …

Article 11 : Intellectual ownership

Larabesko’s website, logos, texts, photos, names and in general all communications are protected by intellectual property rights held either by Larabesko, or by Larabesko’s suppliers or other entitled parties. It is prohibited to use and / or make changes to the intellectual property rights as described in this article, without the prior and express written permission of Larabesko.

Article 12 : Infringement of validity – non-renunciation

If any provision of these terms and conditions is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions. Failure at any time by Larabesko to enforce or exercise any of the rights listed in these terms and conditions will never be considered a waiver of such provision and will never affect the validity of these rights.

These terms and conditions are supplemented by other terms and conditions that are explicitly referred to and the general sales conditions of Larabesko. In case of contradiction, these terms and conditions prevail. Larabesko can always change these conditions. Any order after the change implies acceptance by the customer of these new conditions.

Article 15 : Proof

The customer accepts that electronic communications and backups can serve as evidence.

Article 16 : Applicable law – Competent court

Belgian law applies to the exclusion of the provisions of private international law and all foreign legal systems. In case of disputes, only the courts in Ghent are competent.
